If the Conclave of Cardinals breached their fiduciary duties by electing Benedict the pretender, then clearly that election is invalid. This can be verified very simply. The cardinals are the senior officlals charged with the management of the Church. One of their duties is to choose the pope. They are the stewards of the Church for all Catholics. As such they have a fiduciary duty and should not exercise their power for their own benefit and aggrandizement. They did!
